Terms and ConditionsYou are connected to the User Agreement for oneonine (109) Jewellery Ltd, registered address 5 Erin Close, London, SW6 1BF. This service is operated by oneonine Jewellery Ltd. 1. The Contract between you and 109 Jewellery Ltd Your order has been accepted when we have received the full payment for your order, and you will receive an email confirming this. We will use the email address you provide when placing the order. We will also inform you if there should be any unforeseen circumstances meaning we cannot fulfill the order. Once the order is shipped then we have also accepted your order. You will be notified when the order has been accepted via email. Upon accept of your order we also enter a legally binding contract between us. Legally binding contracts can only be between adults and you will therefore have to be 18 to order from the website.
2. Pricing, Delivery and Discount Codes
2.1 The prices stated on our website are the prices your will be charged for goods. All prices are in GBP.
2.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. See our delivery charges here.
2.3 Discount codes and vouchers: Sometimes we offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this website. Promotional codes cannot be used in conjunction with other offers and discounts.
3. Right for you to cancel your contract
3.1 You can cancel your contract with us within 10 days after receiving the goods purchased from the website.
3.2 To cancel your contract send us an email telling us at hello@109jewellery.co.uk.
3.3 The terms for terminating a contract with us are: A. You not having worn or damaged the jewellery. B. You must write to us within 10 days of receiving your goods to get the return confirmed by us. C. Bespoke items cannot be returned
3.4 When you have returned the goods after agreement with 109 Jewellery, your account will be credited with the full amount you paid for the Jewellery. Delivery charges will not be refunded. Refund may take up to 14 days working days, provided the goods are in the same condition as when shipped to you.
4. Cancellation by us
4.1 We reserve the right to cancel the contract between you and us if: A. We do not have any stock B. If we cannot deliver in your area. C. If we have shown the wrong price on the website due to typographical error.
4.2 If we have to cancel the contract with you then we will refund the full amount to your accounts including delivery charges. We do not pay any compensation.
5. Delivery of goods to you
5.1 All orders are sent with royal mail first class signed for.
5.2 We send to the delivery address you provided when placing the order. It is your responsebilty to be there for the delivery.
5.3 Delivery in the UK and EU is free of charge. Outside Europe is £12.95. Your delivery within the UK should arrive within 1-4 days. Please allow a bit longer in Europe. For deliveries outside Europe allow up to 21 days depending on local customs and delivery services. We ship orders daily in the order they are placed.
5.4 If you wish for your goods to be delivered with a courier service anywhere in the world please contact us on either telephone +44 (0)20 76 190 390 or email hello@109jewellery.co.uk for a price.
For urgent orders within London postcodes, you can use our London Same Day courier service for which we charge a flat fee of £20. This needs to be arranged by telephone. Click here to view full delivery charge details
5.5 The goods are owned by you when shipped by us, and we take no responsebilty for the goods when they have left our hands.
5.6 We make no promise that materials on our website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
5.7 If your order is returned to us by postal services or courier because they could not deliver the goods at the address provided by you, then you are responsible to pay for delivery again.
5.8 We are not reliable for any extra tax insurance cost you may experience when the goods are passing border and all packages sent from us will be labelled as stated on the invoice.
6. Liability
6.1 If the goods are broken or the quantity is wrong then you have to notify us within 10 days.
6.2 If you do not receive your ordered goods within 4 days for UK, 14 days for Europe and 21 working days of the date on which you ordered them for outside Europe, we shall have no liability to you unless you notify us by e-mail. If you notify us of a problem under this condition, our only obligation will be, at your option either:
6.2.1 To attempt a new delivery
6.2.2 to replace any goods that are damaged or defective
6.2.3 to refund to you the amount paid by you for the goods.
6.2.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause
6.3 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
6.4 We cannot take responsibility for the service provided by royal mail and the courier service.
7. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address at hello@109jewellery.com.
8. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
9. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
10. Third Party
Third Party Rights: Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
11. Governing Law
Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.
12. Entire Agreement
12.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions.
12.2 We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.
13. Trade Marks
Oneonine Jewellery Ltd is the operator of www.109jewellery.co.uk. All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners' rights.
14. Events Beyond our Control
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
15. Our rights
We reserve the right to change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website. |
